Terms of Sale
These terms of sale govern your purchase of any product offered on our website. Please read these terms of sale carefully as they contain important information about your rights and obligations, as well as limitations and exclusions that may apply to you. By placing an order, you acknowledge that you have read, accepted, and agreed to be bound by these terms of sale, without limitation or qualifications. These terms of sale are subject to modification without prior written notice at any time in our sole discretion.
1) Products
We may discontinue any product at any time without notice. Product images on the website are for illustrative purposes only and may differ from the actual product. The product prices displayed do not include shipping and handling or sales taxes, if applicable, which will be added to your total invoice price.
2) Price Errors
Our goal is a 100% error-free website. If product price errors are discovered, they are promptly corrected in our systems, and the corrected price will apply. We will notify you if your order includes items that were incorrectly priced.
3) "Value Brand" Products
The term "Value Brand" on our website refers to items meeting or exceeding the specifications listed. Value Brand items are manufactured by various companies. Trademarks and trade names of other companies used in product comparisons are for the purpose of comparing products of similar characteristics. Orders for Value Brand products may include items manufactured by different companies.
4) Orders
Orders are not binding upon us until accepted. We reserve the right, without prior notification, to limit the order quantity on any item and/or refuse service to any customer. Verification of information may be required prior to the acceptance of any order. Orders will be processed in the order they are received during our operational business hours. All changes to processing orders must be made over the phone with a representative. Orders cannot be changed once they have shipped, regardless of the order status as it appears online.
5) Payment
Payment can be made with major credit cards and PayPal. Your credit card will be charged when your order is placed. We also accept Purchase Orders from customers who have received credit approval. A service charge may be added to unpaid balances under certain conditions. If an account is placed with a third party for collection, the buyer agrees to pay all costs and expenses of collection, including reasonable attorneys' fees, in addition to the service charges stated above.
6) Sales Tax
You are responsible for the payment of any state and local sales or use taxes that may apply to your order. The sales tax is calculated based on the full invoice price, and may include charges for shipping and handling if required by law. We are required by law to collect sales tax for orders shipped within certain states.
7) Delivery
While we make every reasonable effort to ship your orders within reasonable time frames, we are not responsible or liable for any delay in receiving or completing your order caused by events beyond our reasonable control. Such events may include, but are not limited to, natural disasters, strikes, civil unrest, and technical failures.
8) International Shipments
The minimum order for shipments outside the 50 United States is $100.00 (U.S). Shipments to certain locations will incur additional shipping charges. The customer is responsible for payment of taxes, duties, tariffs, and any other charges levied by government agencies. Payment must be made in full using a credit card or bank transfer
at the time of shipment. Title and risk of loss pass to the customer upon delivery to the carrier.
9) Shipping & Handling (S&H) Charges
S&H charges apply to all orders. Additional charges will apply for orders outside the contiguous states and for upgraded services. S&H charges are non-refundable unless there is an error on our part. Freight shipments may incur additional delivery charges under certain conditions.
10) Warranties
ALL PRODUCTS ARE SOLD "AS IS," AND WE DISCLAIM ALL WARRANTIES OF ANY KIND RELATING TO THE PRODUCTS OR USE THEREOF, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, TITLE, OR FITNESS FOR A PARTICULAR PURPOSE. Some jurisdictions may not allow exclusions of implied warranties, so these exclusions may not apply to you.
11) Return & Restocking Policy
We stand behind our products and offer a refund, replacement, or credit if you are not satisfied with your purchase, provided you notify us within 14 days of receipt. A restocking charge may apply. Refunds will be made via the original payment method. Conditions apply for certain products and orders.
12) Mistaken and Damaged Shipments
We will replace orders and refund shipping costs for errors on our part. Claims for replacement or credit must be made within 14 days of delivery. Keep original packaging for potential inspection or return. Limitations on the number of delivery attempts may apply based on delivery history.
13) Limitation of Liability
WE SHALL NOT BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR INCIDENTAL DAMAGES ARISING FROM ANY CLAIM RELATING TO THESE TERMS OF SALE, PRODUCTS, OR ORDERS. OUR LIABILITY IS LIMITED TO THE AMOUNT PAID FOR THE RELEVANT ORDER OR PRODUCT.
14) Severability
If any provision of these Terms of Sale is deemed unenforceable, it shall be severed, and the validity of the remaining provisions shall not be affected.
15) Governing Law
These Terms of Sale shall be governed by the laws of the State.
16) Arbitration
Any disputes arising out of these Terms of Sale shall be settled by arbitration in Michigan under the rules of the American Arbitration Association.
17) Jurisdiction and Venue
Legal actions arising out of these Terms of Sale must be brought exclusively in federal or state courts in Michigan, to which both parties irrevocably submit.
